TERMS AND CONDITIONS OF THE JEDMAR ONLINE STORE

I. GENERAL PROVISIONS

The owner of the online store jedmar.pl is F.H. "JEDMAR" Piotr Jędras, hereinafter referred to as the Seller, located at ul. Graniczna 36, 62-007 Bugaj, NIP: 7842027842, REGON: 634495640. Customers can contact the Seller via phone at +48 607 270 252 or email at info@jedmar.pl. The company is registered in the Central Registration and Information on Business (CEIDG) maintained by the Minister of Entrepreneurship and Technology.
The agreement concluded between the Customer and the Seller regarding the purchase of goods on jedmar.pl is temporary and lasts for the duration of order fulfillment. The place of performance of the service related to the purchase of goods is the delivery address indicated by the Customer. Payment can be made via bank transfer to CREDIT AGRICOLE 30194010765270325600000000 or cash on delivery. A VAT invoice is issued upon order fulfillment.
By using the jedmar.pl website and/or placing an order, you accept these Terms and Conditions ("Terms"). Please read the Terms before placing an order.
II. PROCEDURE FOR CONCLUDING A SALES AGREEMENT

To make a purchase in the store, the Customer must correctly fill out the order form and accept the terms and delivery costs specified in the form. All available goods are brand new, free from physical and legal defects, and have been legally introduced to the Polish market. All products include manufacturer and importer declarations of compliance with applicable EU standards.
All prices in the store are expressed in Polish zloty (PLN) and include VAT (gross prices). The cost of delivery is added to the product price, depending on the chosen delivery and payment method.
The information on the jedmar.pl website does not constitute an offer within the meaning of Article 66 and subsequent articles of the Civil Code but rather an invitation to submit offers. By completing the order form, the Customer submits an offer to purchase a specific product under the terms described. Product images may show different variants, colors, and packaging.
The Customer selects the product, payment method, and delivery option. Each order is confirmed via email in the following stages:
  • Order confirmation
  • Notification of product shipment

The jedmar.pl online store offers the following payment methods:
  • Cash on delivery (payment is made to the courier upon receipt of the package)
  • Bank transfer (accepted transfers include fast transfers via PayU, where the customer is redirected to their selected bank's website to complete the transaction, or a traditional electronic transfer)
  • Credit/debit card (the customer must use a card that supports online payments; verification of this feature should be done with the issuing bank). Payments are processed via PayU.

IV. DELIVERY METHOD AND ORDER FULFILLMENT TIME

The Customer bears the cost of delivery. The standard order processing time is 2 business days from the moment the payment is credited to the bank account specified in the general information. Any changes to the processing time or the inability to fulfill an order will be communicated to the Customer via phone or email.
Orders are shipped daily from Monday to Friday to the addresses provided in the order. Shipments are made within Poland and to European Union countries. Delivery is carried out by the DPD courier service. The Customer has the right to inspect the shipment in the presence of a DPD representative, as this service is offered by the courier company.
The Seller is not responsible for non-delivery or delayed delivery due to incorrect or incomplete address details provided by the Customer.
V. COMPLAINTS
The Buyer may submit complaints regarding the concluded Agreement to the Seller via email at info@jedmar.pl or in writing to the Seller's address. A properly submitted complaint should include:
  • Full name, address, email address of the Buyer
  • Date of the Agreement underlying the complaint
  • Subject of the complaint and the Buyer's request
  • Circumstances justifying the complaint

If the information provided in the complaint requires supplementation, the Seller will ask the complainant to provide additional details. The Seller will process the complaint within 14 days from its receipt in the correct form. The response to the complaint will be sent to the email or postal address provided by the Buyer.

VI. RIGHT TO WITHDRAW FROM THE AGREEMENT

A Customer who is a consumer has the right to withdraw from the sales agreement within 14 calendar days from receiving the ordered goods without providing a reason. However, returns are not accepted for products that, by law, are non-returnable.
In case of withdrawal, the consumer bears the cost of returning the goods to the store. The Seller will refund all received payments, including the delivery cost from the store to the Customer (except for additional costs resulting from the Customer's choice of a delivery method other than the cheapest standard delivery offered by the Seller), immediately and no later than 14 days from the date the Seller was informed of the withdrawal decision. The returned goods must be unused and undamaged, and the Customer is responsible for properly securing them during transit. Returned products must be complete.
VII. PROCESSING OF PERSONAL DATA

By placing an order, the Customer agrees to the processing of their personal data provided in the order form. The Customer's personal data is entered into the database of F.H. "JEDMAR" Piotr Jędras. The Seller is the administrator of the personal data collected from customers in connection with purchases in the online store.
The processed data includes: company name, first and last name, address, phone number, and email address. The Customer may consent to the use of their data by F.H. "JEDMAR" Piotr Jędras for promotional and marketing purposes. Customers of jedmar.pl have the right to access, modify, update, and request the deletion of their data, in accordance with the Personal Data Protection Act of August 29, 1997 (Journal of Laws 1997 No. 133, item 883 as amended) and the General Data Protection Regulation (GDPR) (EU) 2016/679.
VIII. FINAL PROVISIONS

Each Customer is required to familiarize themselves with the Terms, and placing an order in the store constitutes acceptance of its provisions. The Seller reserves the right to amend the Terms. Any changes take effect no earlier than 7 days from their publication on the website.
The Customer has the right to use out-of-court complaint handling and dispute resolution methods. A Customer who is a consumer may seek assistance from a municipal or district consumer ombudsman. The competent court for disputes arising from the sales agreement is:
  • The court of the place of performance for consumer Customers
  • The court of the Seller’s registered office for business Customers
In matters not regulated by these Terms, the provisions of Polish law, including the Civil Code and the Act on Electronic Services, as well as EU law, including GDPR, apply.
These Terms have been in effect since November 1, 2015.
